General Terms and Conditions and Withdrawal Information for Consumers.
§ 1. Contract Partner
These General Terms and Conditions apply to orders placed by consumers through the Infilus online shop.

A consumer is any natural person acting mainly for purposes outside their trade, business or profession.
§ 2. Scope
These Terms apply to all consumer orders placed through our website. Any conflicting terms from the customer do not apply unless we expressly agree to them in writing.
§ 3. Products and Order Process
Product listings in our online shop are not a binding offer but an invitation to place an order.
By clicking the button marked "Order with obligation to pay" or similar wording, you submit a binding offer to purchase the selected products.
The contract is concluded only when we accept your order by sending an order confirmation, shipping confirmation, or by dispatching the goods.
We may decline an order in justified cases, for example if a product is unavailable, a pricing error occurred, or fraud is suspected. Any payments already made will be refunded without undue delay.
§ 4. Prices and Payment
All prices shown in the shop are final prices and include applicable VAT unless stated otherwise. Shipping costs are shown separately during checkout.
Payment can be made using the payment methods offered in the shop at the time of purchase. The goods remain our property until full payment has been received.
§ 5. Delivery
We deliver to the countries shown in our shop. Delivery times shown in the shop are estimates unless expressly stated otherwise.
We use partial deliveries where this is reasonable for you. We will bear any additional shipping cost caused solely by such partial delivery.
The risk of accidental loss or damage passes to you when the goods are delivered to you or to a person authorized by you to receive them.
§ 6. Duty to Check for Transport Damage
Please inspect the parcel on delivery where reasonably possible. If the package is visibly damaged, please inform the carrier and contact us promptly. This helps us handle transport claims. Your statutory rights are not affected.
§ 7. Statutory Rights for Defective Goods
Your statutory rights in the event of defective or non-conforming goods apply in full.
If a product is defective, you are entitled to the remedies provided by law. As a rule, we may first repair or replace the goods, unless this is impossible or disproportionate.
Any commercial guarantee offered by a manufacturer is separate from your statutory rights and does not limit them.
§ 8. Limitation of Liability
We are fully liable for intent, gross negligence, injury to life, body or health, under mandatory product liability law, and in all other cases where liability cannot be excluded by law.
In cases of slight negligence, we are liable only for breaches of essential contractual obligations, and only for typical and foreseeable damage.
§ 9. Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.
If you ordered several goods in one order and the goods are delivered separately, the withdrawal period starts on the day you, or a third party named by you, took possession of the last good.

by means of a clear statement of your decision to withdraw from the contract, for example by email or post.
You may use the model withdrawal form below, but this is not mandatory. To meet the deadline, it is sufficient that you send your notice of withdrawal before the 14-day period expires.
§ 10. Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including the cost of the standard outbound delivery option offered for your order, without undue delay and no later than 14 days from the day on which we receive your withdrawal notice.
We may withhold reimbursement until we have received the returned goods or until you have provided proof that you have sent back the goods, whichever is earlier.
We will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you. You will not be charged any fee for the reimbursement.
You must send back the goods without undue delay and in any event no later than 14 days from the day on which you notified us of your withdrawal. The deadline is met if you send the goods before the 14-day period has expired.
Unless we expressly state otherwise, you bear the direct cost of returning the goods. You are only liable for any diminished value of the goods if that diminished value results from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
§ 11. Exclusions from the Right of Withdrawal
The right of withdrawal does not apply, to the extent permitted by law, to contracts for:
- Goods made to the consumer's specifications or clearly personalized;
- Sealed goods not suitable for return for health protection or hygiene reasons, once unsealed after delivery;
- Goods liable to deteriorate or expire rapidly;
- Sealed audio, video or software products, once unsealed after delivery;
- Goods which, after delivery, have been inseparably mixed with other items by their nature;

§ 13. Consumer Dispute Resolution
Please contact us first at info@infilus.com if you have any complaint. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration body, insofar as this is required or relevant under applicable law.
§ 14. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer living in another EU or EEA country, you also retain the protection of mandatory consumer laws of your country of residence.
§ 15. Severability
If any provision of these Terms is wholly or partly invalid, the validity of the remaining provisions remains unaffected to the extent permitted by law.
